PLEASE READ THE FOLLOWING APP STORE MARKETING ARTWORK LICENSE AGREEMENT (“MARKETING AGREEMENT”) CAREFULLY BEFORE DOWNLOADING OR USING THE APPLE ARTWORK (AS DEFINED BELOW). THESE TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND APPLE.

You agree that Your use of the Artwork will be in strict compliance with the App Store Marketing and Advertising Guidelines for Developers found at https://developer.apple.com/app-store/marketing/guidelines/, which may be amended from time to time and also with Apple’s Guidelines for Using Apple Trademarks and Copyrights, found at https://www.apple.com/legal/intellectual-property/guidelinesfor3rdparties.html, which may be amended from time to time.

3. Apple may use Your name and the name of each of Your Applications in any index of products or developers that work with Apple-branded products running iOS, watchOS, tvOS, or macOS.

5. Upon Apple’s request, You shall supply Apple, at no cost and with no obligation to return, suitable specimens of Your use of the Artwork to verify Your compliance with this Marketing Agreement.

6. Apple shall remain the exclusive owner of all rights in the Artwork. Your use of the Artwork shall exclusively inure to the benefit of Apple. You will not do anything to compromise Apple’s rights in and to the Artwork, such as filing any identical or confusingly similar trademark applications anywhere in the world.

7. THE ARTWORK IS PROVIDED TO YOU ON AN “AS IS” BASIS AND YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF THE ARTWORK. APPLE DISCLAIMS ALL WARRANTIES REGARDING THE ARTWORK, INCLUDING WARRANTIES OF NON-INFRINGEMENT. APPLE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE ARTWORK, OR TERMINATION OF THIS MARKETING AGREEMENT.

8. To the extent permitted by applicable law, You agree to indemnify and hold harmless, and upon Apple’s request, defend, Apple, its directors, officers, employees, independent contractors and agents (each an "Apple Indemnified Party") from any and all claims, losses, liabilities, damages, taxes, expenses and costs, including without limitation, attorneys’ fees and court costs, incurred by an Apple Indemnified Party and arising from or related to Your use of the Artwork in any manner except as expressly permitted by this Marketing Agreement, or for any personal injury, product liability or other claim arising from the production, promotion, distribution, sale and/or offer for sale, and/or the performance of the Applications.

10. This Marketing Agreement shall terminate automatically upon Your breach of any of the terms of this Marketing Agreement. Apple may terminate this Marketing Agreement at will upon 10 days’ written notice. If Apple terminates this Marketing Agreement, You may, except in the event that the Artwork is subject of a claim of infringement, deplete existing inventory for a period of 30 days following the notice of termination, provided such inventory is in compliance with the terms of this Marketing Agreement.

11. Any litigation or other dispute resolution between You and Apple arising out of or relating to this Marketing Agreement will take place in the Northern District of California, and You and Apple hereby consent to the personal jurisdiction of and exclusive venue in the state and federal courts within that District with respect any such litigation or dispute resolution. This Marketing Agreement will be governed by and construed in accordance with the laws of the United States and the State of California, except that body of California law concerning conflicts of law.

If You (as an entity entering into this Marketing Agreement) are a U.S. public and accredited educational institution, then (a) this Marketing Agreement will be governed and construed in accordance with the laws of the state (within the U.S.) in which Your educational institution is domiciled, except that body of state law concerning conflicts of law; and (b) any litigation or other dispute resolution between You and Apple arising out of or relating to this Marketing Agreement will take place in federal court within the Northern District of California, and You and Apple hereby consent to the personal jurisdiction of and exclusive venue of such District unless such consent is expressly prohibited by the laws of the state in which Your educational institution is domiciled.

12. You shall promptly notify Apple in writing of any change in Your physical or electronic address via the App Store Connect tool and/or the Apple Developer website.

Following warranty service your Apple Product or a replacement product will be returned to you as your Apple Product was configured when originally purchased, subject to applicable updates. Recovery and reinstallation of other software programs, data and information are not covered under this warranty.

If during the Warranty Period you submit a valid claim to Apple or an AASP, Apple will, at its option, (i) repair the Apple Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the Apple Product with a product that is at least functionally equivalent to the Apple Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the Apple Product for a refund of your purchase price.

Apple may request that you replace certain user-installable parts or products. A replacement part or product, including a user-installable part that has been installed in accordance with instructions provided by Apple, assumes the remaining warranty of the Apple Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes Apple"s property.

If the Apple Product is still not functioning properly after making use of these resources, please contact an Apple representative or, if applicable, an Apple owned retail store ("Apple Retail") or AASP, using the information provided below. (i) Carry-in service. You may return your Apple Product to an Apple Retail or AASP location offering carry-in service. Service will be performed at the location, or Apple Retail or an AASP may send your Apple Product to an Apple Repair Service (“ARS”) location to be serviced. Once you are notified that service is complete, you will promptly retrieve the Apple Product from the Apple Retail or AASP location, or the Apple Product will be sent directly to your location from the ARS location.

(ii) Mail-in service. If Apple determines that your Apple Product is eligible for mail-in service, Apple will send you prepaid waybills and if applicable, packaging material, so that you may ship your Apple Product to an ARS or AASP location in accordance with Apple’s instructions. Once service is complete, the ARS or AASP location will return the Apple Product to you. Apple will pay for shipping to and from your location if all instructions are followed.

(iii) Do-it-yourself (DIY) parts service. DIY parts service allows you to service your own Apple Product. If DIY parts service is available in the circumstances, the following process will apply.

(a) Service where Apple requires return of the replaced product or part. Apple may require a credit card authorization as security for the retail price of the replacement product or part and applicable shipping costs. If you are unable to provide credit card authorization, DIY parts service may not be available to you and Apple will offer alternative arrangements for service. Apple will ship a replacement product or part to you with installation instructions, if applicable, and any requirements for the return of the replaced product or part. If you follow the instructions, Apple will cancel the credit card authorization, so you will not be charged for the product or part and shipping to and from your location. If you fail to return the replaced product or part as instructed or return a replaced product or part that is ineligible for service, Apple will charge your credit card for the authorized amount.

(b) Service where Apple does not require return of the replaced product or part. Apple will ship you free of charge a replacement product or part accompanied by instructions on installation, if applicable, and any requirements for the disposal of the replaced product or part.

If you seek service in a country that is not the country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. Our goal is to one day make every Apple product with 100% recycled or renewable materials. To achieve that, we need to design devices to use more recycled content and make sure these materials get recovered when products reach end-of-life. When we use recycled and renewable materials, we lower our reliance on mining, shipping, and processing raw materials, thereby reducing our carbon footprint and conserving precious natural resources. Aluminum is one of our most widely used materials, and it represented over a quarter of our product manufacturing footprint in 2015. So we developed a 100% recycled alloy that still meets our high standards for performance and durability. The new Apple Watch Series 8 and Apple Watch SE use 100% recycled aluminum in their cases — joining all iPad models, MacBook Air, Mac mini, and the 14‑inch and 16‑inch MacBook Pro models. Thanks to these changes, aluminum made up less than 10% of our 2021 product manufacturing footprint.

Every Apple product contains materials that can be used to build new ones. And research from our Material Recovery Lab in Texas helps us reclaim more of those building blocks with innovative tools and technologies. Daisy, Dave, and Taz, our disassembly robots, take apart iPhone devices and components to recover crucial materials like gold, cobalt, tungsten, and rare earth elements. These collected materials make it back to the raw materials marketplace so that we, and others, can use recycled materials for the next generation of products. Improving the ways we source and recycle precious materials is one of the many ways we can reduce the carbon impact of our products and preserve our planet’s natural resources.
